01Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the website wd-automation.com and the TIRU freight platform, operated by White Diamond for General Transportation, General Services, Electronic Automation, and Logistical Support Ltd. ("White Diamond", "we", "us").
By accessing our website or using the TIRU application, you agree to be bound by these Terms. If you do not agree, please do not use our services.
02Definitions
In these Terms, the following definitions apply:
- "Platform" means the TIRU website and mobile application.
- "Cargo Owner" means a user who requests the transportation of goods.
- "Carrier" means a truck or trailer owner or driver who provides transportation services.
- "User" means any person who accesses or uses our services, including Cargo Owners and Carriers.
- "Services" means the website, the Platform, and all related features provided by White Diamond.
03Eligibility & Account Registration
To use the Platform, you must be at least 18 years of age and legally able to enter into a binding contract. You are responsible for providing accurate registration information and for keeping your account credentials confidential, and for all activity that occurs under your account.
04The TIRU Platform
TIRU is a technology platform that connects Cargo Owners with independent Carriers based on the principle of the sharing economy. White Diamond provides the Platform that facilitates these connections; it does not itself own or operate the trucks and is not a party to the transport agreement between a Cargo Owner and a Carrier.
The contract for the transportation of goods is concluded directly between the Cargo Owner and the Carrier. White Diamond is not responsible for the acts, omissions, or conduct of any User.
05User Obligations
You agree to use our Services only for lawful purposes and in accordance with these Terms, and to provide accurate and complete information, including cargo details, weight, and pickup and delivery locations. Carriers are responsible for holding valid licenses, permits, and insurance required to operate under the laws of the Republic of Iraq.
06Payments and Fees
Any fees, pricing, or payment arrangements applicable to the Services or to a shipment will be communicated through the Platform or agreed between the parties. You agree to pay all applicable charges for the Services you use. Unless stated otherwise, fees are exclusive of any taxes that may apply.
07Prohibited Activities
When using our Services, you agree not to:
- Transport any goods that are illegal, prohibited, or hazardous without proper authorization.
- Provide false, misleading, or fraudulent information.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Platform or its systems.
- Use the Services to harass, harm, or defraud any other User.
- Violate any applicable law, regulation, or third-party right.
08Intellectual Property
All content on the website and the Platform — including text, graphics, logos, designs, and software — is the property of White Diamond or its licensors and is protected by applicable intellectual property laws. "TIRU" and associated marks are trademarks owned by White Diamond Ltd. You may not copy, reproduce, or use any of this content without our prior written permission.
09Disclaimers
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. While we strive to keep the Platform reliable and accurate, we do not guarantee that the Services will be uninterrupted, error-free, or secure, or that any shipment will be completed within a particular time.
10Limitation of Liability
To the maximum extent permitted by applicable law, White Diamond shall not be liable for any indirect, incidental, or consequential damages, or for any loss of profits, goods, or data, arising from your use of the Services or from any transaction between a Cargo Owner and a Carrier. Nothing in these Terms excludes liability that cannot be excluded under the law of the Republic of Iraq.
11Governing Law & Disputes
These Terms are governed by the laws of the Republic of Iraq. Any dispute arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts of Baghdad, Iraq.
12Changes to These Terms
We may update these Terms from time to time. The most recent version will always be posted on this page with the date of the latest update. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
